Terms of Service

These terms are the agreement between you and Rohan Panda, who operates BrokenCode (“BrokenCode”, “we”), covering your use of brokencode.in. How we handle personal data is covered separately in our Privacy Notice, which these terms do not override.
1. Who may use BrokenCode
Practice is open to all ages. If you are under 18 you may use practice mode, and we never apply analytics or behavioural tracking to your account.
Company assessments require you to be 18 or over. You tell us your age bracket when you sign up, and an account declared as under 18 cannot start an employer’s assessment.
If you are under 18, your parent or guardian must agree to these terms on your behalf. We are building the verification step for this; until it is live, accounts declared as under 18 are not activated.
If you are agreeing on behalf of a company, you confirm you are authorised to bind it and that you are 18 or over.
2. Accounts
Keep your credentials secure and tell us promptly if you think they have been compromised. You are responsible for activity under your account. Give us accurate information and keep it current — in particular, an email address you actually read, since that is how we reach you.
3. Assessments and scoring
Assessment scores are produced by an AI evaluator without human review. Scores are an aid to judgement, not a verdict:
- If you are a candidate, the hiring decision belongs to the employer who invited you, not to us. We cannot change a hiring outcome, but we will explain how a score was produced if you ask.
- If you are an employer, you are responsible for your hiring decisions and for any human review, notice, or audit your jurisdiction requires. Do not treat a score as the sole basis for a decision.
- Scores are generated by a statistical system and will sometimes be wrong. We do not warrant that any score is accurate or fit for a particular hiring decision.
4. Acceptable use
You agree not to:
- Sit an assessment as, or on behalf of, someone else, or help anyone else do so.
- Attempt to obtain reference answers other than by completing an assessment, or share them once revealed to you.
- Scrape, bulk-download, or resell question content. Questions and reference answers are our intellectual property.
- Probe, scan, or attempt to circumvent access controls, except as permitted by the responsible disclosure terms on our security page.
- Upload unlawful content, or anyone else’s personal data beyond what an assessment requires.
- Use company assessments to assess anyone under 18.
We may suspend an account that breaches these terms. Where the breach is not serious we will try to warn you first.
5. Credits and payment
Company accounts buy assessment credits in advance. One credit runs one assessment. Prices are shown in Indian Rupees and include any taxes stated at checkout. Payments are handled by Razorpay; we never receive your card or bank credentials.
Credits expire 12 months after purchase. A credit is consumed when a candidate begins the assessment it was reserved for; if an invitation expires unused, the credit returns to your balance.
Refunds: credits you have not used are refundable within 14 days of purchase, less any payment-processing fee we cannot recover; credits already consumed by a started assessment are not refundable. Where we withdraw the service or materially fail to provide it, we will refund unused credits pro rata.
6. Your content
You keep ownership of what you write. You grant us the licence we need to operate the service — storing your answers, sending them to our AI grading provider, and showing results to the employer who invited you.
We do not use your answers to train AI models.
7. Our content
Questions, reference answers, code snippets, and the platform itself remain ours. You may use them to practise or to run assessments; you may not republish, resell, or build a competing question bank from them.
8. Availability
We aim to keep the service available but do not promise uninterrupted access, and we may take it down for maintenance. There is no contractual uptime commitment unless we have agreed one with you in writing.
9. Ending the agreement
You may stop using the service and delete your account at any time from your account settings. We may terminate for material breach, or for any reason on 30 days’ notice, in which case we refund unused credits pro rata. What happens to your data on termination is set out in the Privacy Notice and, for customers, the DPA.
10. Disclaimers and liability
The service is provided as-is. To the extent the law allows, we exclude implied warranties, and we are not liable for indirect or consequential loss, lost profits, or lost opportunity — including any hiring decision made using our scores. Our total liability is capped at the total amount you paid us in the 12 months before the claim arose. Nothing here limits liability that cannot lawfully be limited.
11. Governing law
These terms are governed by the laws of India, and the courts of India have exclusive jurisdiction. Before starting proceedings, please write to us at brokencode.team@gmail.com so we can try to resolve the matter directly.
12. Changes
We may update these terms. For changes that materially affect your rights we will give you reasonable notice before they take effect. Continuing to use the service after that means you accept the new terms; if you do not, you may close your account and we will refund unused credits pro rata.
